UT stelt zich op het standpunt dat de opdracht voor het aankoop en installatie van Fan Filter Units voor het NanoLab (cleanroom) rechtstreeks aan LUWO B.V. kan worden gegund vanwege het ontbreken van mededinging om technische redenen in de zin van artikel 2.32 lid 1 sub b bullet 2 Aw 2012. Bijgevoegde motivering geeft motivering voor dit standpunt. Belanghebbenden/ondernemingen die zich benadeeld achten door de beoogde gunning aan LUWO B.V. hebben de gelegenheid om tot en met 21 mei 2026 bezwaar aan te tekenen tegen het voornemen tot het gunnen van de overeenkomst door het aanhangig maken van een kort geding bij de rechtbank Overijssel.
